Fittable Terms & Conditions

Effective date: April 19, 2026

These Terms & Conditions ("Terms") form a binding agreement between you and Fittable LLC ("Fittable," "we," "our," or "us") governing your use of the Fittable mobile app, web app, public website, operator and business platform, AI features, community and messaging features, connected integrations, support pages, and related services that link to these Terms (collectively, the "Services").

By creating an account, clicking or tapping an acceptance control, purchasing a subscription, using a connected feature, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Authority

  • You must be at least 18 years old to create or use an account unless we expressly allow otherwise in writing.
  • You must provide accurate information and keep it reasonably current.
  • If you use the Services on behalf of a gym, trainer business, coaching company, or other organization, you represent that you have authority to bind that organization to these Terms.
  • You may not use the Services if doing so would violate applicable law, another binding agreement, or a platform policy that governs your use of a connected service.

2. Scope of the Services

The Services may include, without limitation:

  • Workout planning, logging, timing, execution, and performance tracking.
  • Nutrition logging, meal planning, grocery or food-discovery flows, and related commerce features.
  • Biometrics, recovery tracking, connected health-platform data, and related insights.
  • AI-assisted coaching, food-photo estimation, exercise-form analysis, progress-photo analysis, recovery or physical-therapy style guidance, and similar model-driven features.
  • Community, messaging, content-sharing, coach, trainer, gym, CRM, operator, and business-platform workflows.
  • Connections to third-party services such as Apple, Google, Meta, Strava, Spotify, app stores, analytics tools, ad platforms, subscription providers, grocery partners, and payment providers.

We may add, modify, suspend, or discontinue features at any time, including when required for security, legal, product, or vendor reasons.

3. Accounts and Credentials

  • You are responsible for activities that occur through your account and for keeping credentials, devices, and connected-provider access secure.
  • You may not impersonate another person, share credentials in an unauthorized way, or attempt to bypass authentication, rate limits, permissions, or subscription controls.
  • You must notify us promptly if you believe your account, tokens, or connected-service access has been compromised.
  • We may require identity, age, or authority verification where reasonably necessary.

4. Health, Wellness, AI, and No Medical Advice

Fittable is generally offered as a fitness, wellness, nutrition, coaching, and performance platform. The Services, including AI outputs, biometrics, and connected-health features, are provided for informational and lifestyle-support purposes only unless we expressly state otherwise in a separate written agreement.

  • The Services are not medical care, mental-health care, physical therapy, diagnosis, treatment, emergency response, or a substitute for licensed professional advice.
  • AI outputs, food estimates, coaching suggestions, readiness signals, recovery guidance, and similar outputs may be incomplete, inaccurate, or inappropriate for your situation.
  • You are responsible for deciding whether to rely on any recommendation and for consulting qualified professionals where appropriate, especially if you have injuries, health conditions, pregnancy, disordered-eating history, medication issues, or other elevated-risk factors.
  • If you think you are having a medical emergency, call emergency services immediately. Do not rely on the Services for urgent or emergency care.

5. Permissions, Devices, and Connected Services

  • Some features require access to device permissions or connected accounts such as health platforms, location, notifications, camera, photos, Strava, Spotify, or similar providers.
  • You are responsible for reviewing and managing the permissions and scopes you grant.
  • Third-party services are governed by their own terms, privacy notices, platform rules, and technical availability. We are not responsible for third-party outages, policy changes, pricing changes, data quality, or removal of features they control.
  • If you purchase through Apple, Google, or another storefront, that storefront may impose additional terms on billing, cancellation, refunds, and platform use.

6. User Content and License

You may provide content such as messages, photos, videos, workout logs, meals, recipes, comments, notes, usernames, profile details, and similar materials ("User Content").

  • You retain rights you own in your User Content.
  • You grant Fittable a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, format, transmit, display, perform, analyze, and otherwise use User Content as reasonably necessary to operate, secure, improve, and provide the Services, including connected features you choose to enable.
  • You represent that you have all rights, consents, and permissions needed for the User Content you submit, including for media involving other people.
  • You may not submit content that is unlawful, infringing, deceptive, harassing, hateful, sexually exploitative, privacy-invasive, malicious, or otherwise harmful.

7. Community, Coaching, and Business Features

  • If you use community or sharing features, information you choose to share may become visible to other users, coaches, trainers, gyms, business customers, or other intended audiences.
  • If your account is linked to a coach, trainer, gym, or business program, those parties may be able to view and act on information necessary to operate that relationship, subject to the permissions and workflows available in the Services.
  • If you are a business, operator, coach, or gym customer, you are responsible for your own staff, customer communications, contracts, pricing, disclosures, marketing, cancellation practices, and compliance obligations. Fittable provides software tools and is not your legal, medical, or regulatory advisor.
  • You are responsible for obtaining any permissions or notices required before using the Services to message, market to, onboard, coach, or manage end users.

8. Acceptable Use Restrictions

You may not, and may not permit others to:

  • Use the Services for unlawful, fraudulent, deceptive, abusive, or unauthorized purposes.
  • Copy, scrape, harvest, reverse engineer, decompile, probe, or otherwise attempt to extract source code, models, datasets, prompts, rankings, embeddings, or non-public system behavior except where law prohibits a restriction.
  • Interfere with the integrity, security, performance, or availability of the Services, including by introducing malware, abusing automation, or evading technical controls.
  • Access another user’s account, data, subscription, or business workspace without authorization.
  • Use the Services to build or improve a competing product through improper use of our content, outputs, or systems.
  • Upload or submit material that infringes intellectual-property, privacy, publicity, or contractual rights.

9. Subscriptions, Purchases, and Cancellation

  • Paid features may be offered as subscriptions, one-time purchases, packages, session purchases, or other billing arrangements.
  • Prices, billing intervals, included features, trials, renewal terms, taxes, and refund eligibility may vary by product surface, seller, storefront, jurisdiction, promotion, or business relationship.
  • Unless law or a separate written offer requires otherwise, subscriptions generally renew automatically until canceled.
  • If you bought through Apple or Google, you usually must manage cancellation and refund requests through that storefront.
  • If you bought through a business customer, coach, or another commerce flow, the cancellation, renewal, refund, rescheduling, attendance, or session rules tied to that flow may also apply.
  • We may change pricing or packaging prospectively as permitted by law, but we will not retroactively rewrite completed transactions.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, and otherwise process information. By using the Services, you acknowledge that personal information will be handled as described there and in any feature-specific notice, consent flow, or separate agreement that applies.

11. Intellectual Property

  • The Services, including software, branding, layouts, text, graphics, audio, video, design, and non-user content, are owned by Fittable or its licensors and are protected by intellectual-property and other laws.
  • Except for the limited right to use the Services under these Terms, no license or ownership right is transferred to you.
  • You may provide feedback, suggestions, or ideas, and we may use them without restriction or compensation unless prohibited by law.

12. Copyright Complaints

If you believe content in the Services infringes your copyright or other intellectual-property rights, contact us at contact@fittable.ai with sufficient detail for us to review the claim.

13. Suspension and Termination

  • You may stop using the Services at any time.
  • We may suspend, restrict, or terminate access, disable content, or remove integrations if we believe it is reasonably necessary for security, legal compliance, fraud prevention, product integrity, payment issues, repeated infringement, abusive behavior, or violation of these Terms.
  • Sections that by their nature should survive termination will survive, including provisions about payments already owed, intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related terms.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, accuracy, availability, or uninterrupted operation.

We do not warrant that the Services will always be secure, error-free, accurate, complete, current, or compatible with every device, integration, network, jurisdiction, or workflow.

15. Limitation of Liability

To the maximum extent permitted by law, Fittable and its officers, directors, employees, contractors, affiliates, licensors, vendors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunity, contracts, or anticipated savings, arising out of or related to the Services or these Terms.

To the maximum extent permitted by law, the total aggregate liability of Fittable for all claims arising out of or related to the Services or these Terms will not exceed the greater of (a) the amount you paid to Fittable for the specific paid Service giving rise to the claim during the 12 months before the event giving rise to the claim, or (b) US $100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Fittable and its officers, directors, employees, contractors, affiliates, licensors, vendors, and service providers from and against claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your use of the Services, your breach of these Terms, or your violation of law or the rights of another person or entity.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent consumer-protection law in your jurisdiction requires otherwise. Unless applicable law requires a different forum, the exclusive courts for disputes arising out of or relating to these Terms or the Services are the state and federal courts located in California, and you and Fittable consent to personal jurisdiction and venue there.

18. Changes to the Terms

We may update these Terms from time to time. If we do, we will post the updated version here and update the effective date above. To the extent permitted by law, your continued use of the Services after the updated Terms become effective means the updated Terms apply.

19. General

  • These Terms, together with any incorporated policy, in-product notice, or separate written agreement that applies, form the entire agreement between you and Fittable about the covered Services.
  • If one provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
  • Our failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our prior written consent, except where applicable law invalidates that restriction. We may assign these Terms in connection with a merger, financing, acquisition, reorganization, or sale of assets.
